Workers’ Compensation Case Settlement

The injured worker was a 48-year-old male, employed as a manufacturing technician, who injured his right shoulder and neck while moving a heavy tote at his workplace. The WC Insurer denied the claim, disputing the occurrence of the injury and any causal connection between a work injury and any shoulder or neck symptoms. Our office brought a claim for weekly WC total disability benefits and for medical treatment and the Administrative Judge at the Department of Industrial Accidents ordered full temporary, total disability benefits retroactive to the first date of disability. The Insurer appealed the Conference Order but ultimately withdrew its appeal. The injured worker underwent surgeries to his right shoulder and cervical spine, both of which were paid for by the WC Insurer. We were subsequently able to settle the claim, after bringing a claim for permanent and total disability benefits.
