Implied diminished value

On  October 19, 2021, the Massachusetts Supreme Judicial Court ruled that an auto insurer may now have to compensate the owner of a vehicle damaged in car accident, not just for the cost of repairs, but also for the loss in value of the vehicle should it subsequently be sold, if the amount of the loss can be objectively proven by the owner (i.e. implied diminish value).

This is still evolving case law but we will keep an eye on it.  If you  have questions about your auto accident and how to deal with the insurance  companies, give us a call today.
