Workers’ Compensation Case Settlement

The injured worker was a 61-year-old male asphalt laborer and supervisor who was injured in a work-related accident while operating his company pickup truck. He suffered an injury to his low back and underwent surgery. The WC Insurer filed a complaint for a modification of his temporary, total disability benefits, on the basis of a report of an examination by a physician retained by the Insurer (IME) indicating that he was capable of performing light duty work, including lifting up to 20 lbs; i.e. that he was capable of performing supervisory work. We were able to prevail at the Conference at the Department of Industrial Accidents, maintaining his temporary, total disability status and compensation rate. We were then able to settle his claim at the Hearing level. In addition to the $325,000 settlement amount, we were able to negotiate a substantial reduction of the WC Insurer’s statutory lien over the WC settlement.
