Workers’ Compensation Case Settlement

The injured worker was a 41-year-old female registered nurse, who tripped while entering the facility at which she worked, injuring her right knee. She was diagnosed with multiple ligament and meniscal tears and underwent surgery. The injured worker had been placed on weekly temporary, total disability benefits by the WC Insurer at the time of the injury, but subsequently filed at the Department of Industrial Accidents for a reduction of those benefits, based on a medical report from the Insurer’s examining orthopedic physician indicating she had a light duty work capacity, including a lifting capability of up to 20 lbs., coupled with considerable transferrable skills as an RN. Notwithstanding these arguments, we were able to resolve the claim prior to reaching a Conference at the Department of Industrial Accidents.
